1. Acceptance of Terms

Welcome to Merchnique. By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Merchnique's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on Merchnique's website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

4. Product Descriptions & Pricing

We attempt to be as accurate as possible in describing our products and their pricing. However, we do not warrant that product descriptions, colors, information, or other content available on the Service is accurate, complete, reliable, current, or error-free.

We reserve the right to modify prices without prior notice. In the event a product is listed at an incorrect price due to typographical error or error in pricing information, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

5. Orders & Payments

By placing an order, you warrant that you are legally capable of entering into binding contracts. All orders are subject to acceptance and availability. We reserve the right to refuse any order you place with us.

Payment Methods: We accept online payments via Razorpay (Credit Card, Debit Card, UPI, Net Banking) and Cash on Delivery (COD) with applicable charges.

Order Confirmation: You will receive an email confirmation once your order has been placed. This does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to cancel any order at any time.

6. Shipping & Delivery

We aim to dispatch orders within 3-5 business days. Delivery times may vary depending on your location. Shipping charges are calculated at checkout based on order value:

• Orders above ₹999: FREE shipping
• Orders below ₹999: ₹99 shipping charge
• Cash on Delivery: Additional ₹50 COD charge

We are not responsible for delays caused by shipping carriers or events beyond our control (natural disasters, strikes, etc.).

7. Returns & Refunds

We offer a 7-day return policy for defective or damaged products. Custom-designed products are not eligible for returns unless there is a manufacturing defect.

Return Conditions:

• Product must be unused and in original packaging
• Return request must be initiated within 7 days of delivery
• Product tags and labels must be intact
• Proof of purchase required

Refunds will be processed within 7-10 business days after receiving and inspecting the returned product. Refunds will be issued to the original payment method.

8. Custom Design Services

When you submit a custom design, you warrant that:

• You own all rights to the design or have permission to use it
• The design does not infringe on any third-party intellectual property rights
• The design does not contain offensive, illegal, or inappropriate content

We reserve the right to refuse any custom design request without providing a reason. Custom orders are final and non-refundable unless there is a production error on our part.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Merchnique and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To engage in any automated use of the system, such as scraping or data mining

11. Limitation of Liability

In no event shall Merchnique, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
